When someone is involved in a motor vehicle
collision, their first question is usually, “Who is responsible
for paying my medical bills and the damage done to my car or motorcycle?”
Medical Bills:
Typically, you must first look to your own automobile
coverage, known as No Fault or Personal Injury Protection (“PIP”)
for payment of the first $10,000 in medical bills, lost wages and other
out of pocket losses associated with a medical injury. The Attorneys and
Legal Assistants at Sands, White and Sands P.A. are trained to assist
you in the filing your claim for benefits. We are also skilled in maximizing
your benefits to ensure that you receive all that you are entitled to
under the law. Additionally, this service is provided at no charge
to you.
PIP does not apply if you were on a motorcycle or do not
own a car. However, if you live with a relative who has PIP on their car,
or if you were riding in a car that has PIP, then you will be able to
claim that PIP under that person’s coverage. Unfortunately, there
are numerous exceptions and/or qualifications regarding your entitlement
to PIP coverage. During your initial client conference, we will be able
to determine exactly which coverage applies in your particular case.
If you cannot recover PIP benefits,
then you will have to look to your own health insurance coverage for payment
of your benefits. Also, you may have other insurance coverage that will
pay lost wage benefits if you are disabled and cannot work.
Property Damage:
As for your property damage, you may collect against
either your own insurance company (if you have collision coverage), or
against the at fault party. Typically, you can recover more against the
at-fault driver. At Sands, White and Sands, P.A. we will assist you at
no charge in maximizing the recovery to obtain the full value to repair
or replace your vehicle.
Bodily Injury:
If you are entitled to receive PIP benefits, then
under Florida Law, you may only receive compensation for the pain and
inconvenience you have suffered from your physical injuries if you have
sustained a significant permanent injury. Often, we must wait 6 months
or so before a doctor advises whether or not any injuries you received
are permanent. If you have suffered a permanent injury, then you are entitled
to be compensated. At Sands, White and Sands, P.A., we will maximize your
recovery. If the insurance company is unwilling to settle a claim, we
will file suit to have your claim decided by a jury. We advise all of
our client’s that they, not the attorneys, decide when the case
should be settled.
